Tan Rosie Foods Limited Cooking Retreat Terms and Conditions


These Terms and Conditions apply to any Caribbean cookery and culture retreat (each a “Retreat”) organised, operated or promoted by Tan Rosie Foods Limited (“Tan Rosie”). By making a booking, paying any deposit or attending a Retreat you (the “guest”) agree to be bound by these Terms and Conditions, the booking confirmation, the deposit booking form, the participant waiver and any other documents expressly referred to herein (together the “Agreement”). If you book on behalf of another person you confirm you have authority to accept these Terms and Conditions on their behalf and you will remain responsible for their compliance. Please read these Terms and Conditions carefully before booking. If you do not agree with any provision you must not book or attend the Retreat.

  1. Booking and Deposit
    1.1 The guest agrees to make a reservation by completing the deposit booking form and paying the deposit specified in the confirmation invoice. A contract between the guest and Tan Rosie is formed only when Tan Rosie issues a written booking confirmation and the deposit has been received in cleared funds.
    1.2 The guest agrees that the deposit amount shall be five hundred pounds sterling per person unless otherwise agreed in writing. The deposit secures the guest’s place on the Retreat and shall be credited against the total Retreat price.
    1.3 The guest agrees that the deposit is non‑refundable except as expressly provided in these Terms and Conditions. Payment of the deposit constitutes acceptance by the guest of these Terms and Conditions and a warranty by the guest that all information supplied at booking is true and complete.
    1.4 Tan Rosie reserves the right to refuse or cancel any booking where Tan Rosie reasonably considers that the booking contains materially false information, that the guest is unsuitable for the Retreat or that continuation of the booking would jeopardise health, safety or the enjoyment of other guests. In such circumstances Tan Rosie will refund any sums due in accordance with clause 1.7.
    1.5 The guest agrees that failure to pay any instalment on its due date permits Tan Rosie, at its sole discretion, to treat the booking as cancelled by the guest in accordance with these Terms and Conditions and to retain the deposit in accordance with the cancellation provisions.
    1.6 The guest agrees to pay all sums by the methods specified on the invoice and to bear any bank charges, currency conversion fees or other payment processing charges.
    1.7 If Tan Rosie cancels the Retreat prior to the Retreat start date for any reason other than force majeure, Tan Rosie shall:
    (a) refund to the guest all sums paid in respect of that Retreat, including the deposit, within fourteen days of notification of cancellation; and
    (b) use reasonable endeavours to notify the guest as soon as practicable of the cancellation and the refund arrangements.
    1.8 If Tan Rosie cancels the Retreat for reasons of force majeure clause 11 shall apply.
    1.9 The guest acknowledges and agrees that the refund set out in clause 1.7 shall be the guest’s sole monetary remedy in respect of any cancellation by Tan Rosie and that Tan Rosie shall have no liability for any ancillary costs or consequential losses incurred by the guest, including but not limited to flights, visas, travel insurance premiums and other expenses.

  2. Price and Payment
    2.1 The guest agrees that the published Retreat price is three thousand nine hundred and fifty pounds sterling per person based on shared occupancy in standard rooms at the Mermaid Hotel and Radisson Grenada unless otherwise stated in writing.
    2.2 The guest agrees to pay the balance of the Retreat price in accordance with the instalment schedule set out in the confirmation invoice. Failure to pay any instalment by the due date entitles Tan Rosie to cancel the booking and retain the deposit.
    2.3 The guest agrees that payment reminders will be issued by email and that timely payment remains the guest’s responsibility.
    2.4 The guest agrees to bear any bank charges, currency conversion fees or other payment processing charges incurred in making payments.

  3. Cancellations, Refunds and Transfers by Guest
    3.1 The guest agrees that any cancellation must be made in writing and shall take effect on the date of actual receipt by Tan Rosie.
    3.2 The guest agrees that cancellations will attract the following consequences (unless otherwise agreed in writing):
    (a) cancellations received more than one hundred and twenty days prior to the Retreat start date may, at Tan Rosie’s discretion, be eligible for a refund of sums paid in excess of the deposit, less any applicable administrative or supplier charges;
    (b) cancellations received between one hundred and twenty days and eighty‑four days prior to the Retreat start date shall result in forfeiture of the deposit and may, at Tan Rosie’s discretion, attract a partial refund of any balance paid subject to deduction of supplier charges; and
    (c) cancellations received within eighty‑four days of the Retreat start date shall result in forfeiture of all sums paid and no refund shall be payable.
    3.3 The guest may request a substitution by providing Tan Rosie with the proposed transferee’s full name, date of birth, contact details and any other information reasonably required. Tan Rosie may accept or refuse such request in its reasonable discretion. The guest agrees that:
    (a) any substitution is subject to approval, availability and payment of any administrative and supplier charges;
    (b) the original guest remains liable for all outstanding sums due and for any shortfall between amounts paid and the Retreat price; and
    (c) the transferee must execute any required documentation and comply with these Terms and Conditions prior to participation.

  4. Cancellation by Tan Rosie prior to the Retreat
    4.1 If Tan Rosie cancels the Retreat prior to the Retreat start date for any reason other than force majeure, Tan Rosie shall:
    (a) provide written notice to the guest as soon as reasonably practicable; and
    (b) refund to the guest all monies paid in respect of that Retreat, including the deposit, within fourteen days of cancellation.
    4.2 The guest agrees that the refund set out in clause 4.1 shall be the guest’s sole monetary remedy in respect of such cancellation and that Tan Rosie shall have no further liability for any losses, costs or expenses incurred by the guest, including but not limited to travel costs, visas, travel insurance premiums and loss of enjoyment.
    4.3 If Tan Rosie offers an alternative Retreat date or product following cancellation, the guest may accept or decline the alternative; if the guest declines the alternative the guest shall be entitled to the refund specified in clause 4.1.

  5. Inclusions and Exclusions
    5.1 The guest agrees that the Retreat inclusions are as set out in the itinerary and confirmation and may include accommodation, meals as specified, scheduled activities, local transfers and ferry tickets where stated.
    5.2 The guest agrees that items excluded from the Retreat price shall include international flights, travel insurance, optional excursions not listed as included, drinks except where stated, gratuities, room upgrades and personal expenses.
    5.3 The guest agrees that Tan Rosie shall not be liable for any services arranged independently by the guest.

  6. Accommodation, Room Allocation, Upgrades and Supplements
    6.1 The guest agrees to submit rooming requests in accordance with the rooming form. Room allocation is subject to supplier availability and shall be at the accommodation supplier’s discretion.
    6.2 The guest agrees to pay any single occupancy supplements or upgrade fees within the time specified by Tan Rosie. Failure to pay shall entitle Tan Rosie to relieve itself of the obligation to provide the upgrade or single occupancy allocation.
    6.3 The guest acknowledges that Tan Rosie will use reasonable endeavours to accommodate room preferences but does not guarantee such preferences.

  7. Travel Documents, Health and Insurance
    7.1 The guest agrees to ensure that they hold a valid passport, any required visas and comply with all health entry requirements for Grenada and Carriacou. Tan Rosie shall not be liable for delays or costs arising from the guest’s failure to obtain required documentation.
    7.2 The guest agrees to obtain and maintain appropriate travel insurance which includes cover for cancellation, curtailment, medical expenses, repatriation and personal baggage for the duration of the Retreat and for the activities undertaken. Proof of insurance shall be produced on request.
    7.3 The guest agrees to comply with any health and safety requirements imposed by Tan Rosie or its suppliers including pre‑travel health disclosures and vaccination requirements.

  8. Health, Safety, Conduct and Accessibility
    8.1 The guest agrees to participate in all activities at their own risk and to take reasonable care for their own safety and the safety of others.
    8.2 The guest agrees to follow all instructions, directions and safety briefings given by Tan Rosie staff and third party suppliers.
    8.3 The guest agrees to disclose in writing, prior to booking or as soon as practicable thereafter, any medical conditions, disabilities, allergies, pregnancy or other circumstances that may affect their ability to participate in the Retreat or require special assistance. Failure to disclose may result in refusal of participation or removal from activities without refund.
    8.4 The guest agrees to carry any necessary medication and to adhere to medical advice. Where activities involve additional risk, the guest agrees to sign any required activity‑specific waivers.
    8.5 The guest agrees that Tan Rosie may remove the guest from the Retreat where the guest’s behaviour is, in Tan Rosie’s reasonable opinion, unsafe, illegal or materially disruptive, and that no refund shall be payable in such circumstances.

  9. Liability, Exclusions and Indemnity
    9.1 The guest agrees that elements of the Retreat are supplied by independent third party suppliers and that Tan Rosie acts as organiser and coordinator only.
    9.2 The guest agrees that, except as expressly provided in this clause 9 and to the fullest extent permitted by applicable law, Tan Rosie excludes all liability for loss, damage, injury, expense or delay arising out of or in connection with the Retreat whether arising in tort including negligence, contract, breach of statutory duty or otherwise. This exclusion includes indirect or consequential loss, loss of profit, loss of enjoyment and loss of opportunity.
    9.3The guest agrees that where Tan Rosie is found liable, its total aggregate liability to the guest shall be limited to the total amount paid by that guest for the Retreat.
    9.4 Nothing in these Terms and Conditions shall exclude or limit Tan Rosie’s liability for death or personal injury resulting from its negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by law.
    9.5 The guest agrees to indemnify and hold Tan Rosie harmless from and against all liabilities, losses, claims, demands, damages, costs and expenses including reasonable legal fees arising out of or in connection with the guest’s negligence, breach of these Terms and Conditions, wilful misconduct or failure to disclose material information.

  10. Force Majeure
    10.1 Tan Rosie shall not be liable for any delay or failure in performing its obligations to the extent that such delay or failure is caused by an event beyond its reasonable control including but not limited to acts of God, adverse weather, pandemics, governmental actions, strikes, industrial action, civil unrest, fire, flooding, explosion, acts of terrorism, supplier failures or shortages or any other unforeseeable events.
    10.2 In the event of force majeure Tan Rosie may, at its discretion, cancel the Retreat, change the itinerary, substitute alternative suppliers or facilities or offer a pro rata refund. Tan Rosie shall not be liable for any additional costs incurred by the guest as a result of force majeure.

  11. Itinerary and Operational Changes
    11.1 The guest agrees that all itineraries and schedules are subject to alteration at any time for reasons including but not limited to weather, safety, operational requirements, supplier changes and local conditions.
    11.2 The guest agrees that where changes are necessary Tan Rosie will use reasonable endeavours to provide suitable alternatives of comparable standard but shall not be liable for any loss arising from such changes.

  12. Mandatory Documents, Waivers and Disclosures
    12.1 The guest agrees to complete and return any required waivers, medical disclosure forms and other documentation as requested no later than ninety days prior to the Retreat start date.
    12.2 The guest agrees that failure to return required documentation by the deadline shall entitle Tan Rosie to cancel the booking without refund.

  13. Data Protection and Privacy
    131 The guest agrees that personal data collected in connection with bookings and the Retreat will be processed in accordance with our Privacy Notice available at https://www.tanrosie.com/privacy

  14. Third Party Rights
    14.1 The guest agrees that a person who is not a party to these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Terms and Conditions but this clause does not affect any right or remedy of a third party which exists or is available apart from that Act.

  15. Severability
    15.1 The guest agrees that if any provision of these Terms and Conditions is held to be illegal, invalid or unenforceable in whole or in part such provision shall be severed and the remaining provisions shall continue in full force and effect.

  16. Entire Agreement
    16.1 The guest agrees that these Terms and Conditions, together with the booking confirmation, deposit booking form, participant waiver and any other documents expressly referred to herein, constitute the entire agreement between the parties relating to their subject matter and supersede all prior representations, negotiations and agreements.

  17. Governing Law and Jurisdiction
    17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Kingdom.
    17.2 The guest agrees to submit to the exclusive jurisdiction of the courts of the United Kingdom to determine any dispute or claim arising out of or in connection with these Terms and Conditions.

  18. Notices and Contact Information
    18.1 The guest agrees that notices and other communications to Tan Rosie shall be sent to: Tan Rosie Foods Limited at Unit 4 Chancel Way Industrial Estate, Chancel Way, Witton, Birmingham B6 7AU, telephone 0121 798 1681, email retreats@tanrosie.com  Tan Rosie will use the contact details provided by the guest for notices and communications.
    18.2 Withdrawal of publicity consent and all other notices under these Terms and Conditions must be delivered in writing to the contact details specified in clause 19.1.

  19. Amendments to these Terms
    19.1 Tan Rosie reserves the right to amend these Terms and Conditions from time to time. Any amendment will be published on Tan Rosie’s website or otherwise notified to guests. Amendments will not affect bookings already confirmed except where required by law, regulatory obligation or safety requirement, in which case Tan Rosie shall notify affected guests and use reasonable endeavours to mitigate adverse effects.
